Consigner Contract Terms

Couture appreciates your business and as one of our valued customers, we are committed to selling your designer items at the best possible price.  So that we may operate efficiently, we ask that you comply with the following policies:

1. Consignment
   Consignor authorizes Couture to sell all or any portion of the goods consigned.
   
   
2. Condition
   All garments must be in excellent condition and must be of the highest quality, dry cleaned, on hangers and ready to sell.  Couture retains the right to have the items dry-cleaned, pressed or repaired at the consignor’s expense.
   
   
3. Pricing
   Pricing consultation with the Consignor is welcomed, but Couture has final authority on the selling price.  Couture reserves the right to reduce the price of any article at our own discretion.
   
   
4. Term
   The consignment period is 90 days.  All items are subject to regularly schedule markdown periods occurring at 30 day intervals from the initial date of consignment or at any time per the discretion of Couture.  If any merchandise not sold within the 90-day consignment period, Couture will mail back your items upon request only.  In such cases, you as the consigner will be responsible for all shipping and handling costs.  Items that are not claimed within five (5) days following the end of the consignment period will, without notice, become the property of Couture.  Consigners will not be paid for items sold after the claim date.
   
   
5. Proceeds
   In all cases where Consignor items are sold, Consignor will receive a payment in the amount of 50% of the selling price.  Payments are made by check and will be mailed around the 15th of each month for items sold during the prior month. 
   
   
6. Risk of Loss
   Consignor leaves all item items at his or her own risk.  Couture assumes no liability for loss, destruction or damage of any kind to consigned items (including without limitation fire damage, water damage and theft).
   
   
7. Agreement
   This agreement may not be modified unless in writing and signed by both parties.  All reasonable disputes will be directed to the Hillsborough County better business bureau and will be handled accordingly.
   
   
8. Indemnification
   If any item provided to Couture for resale by the Consigner is found to be counterfeit or if Couture incurs any liability as a result of the sale of such an item, the consigner agrees to indemnify Couture for any damages including any and all judgments, liens, fines, etc.
